In June, the U.S. Supreme Court held in Koontz v. St. Johns River Water Management District that a government agency’s property demands of a permit applicant must satisfy the Nollan/Dolan requirements even in instances that it denies the permit. Further, it determined that the government’s demand must satisfy the Nollan/Dolan requirements even when its demand is for money. After analyzing the decision, our speakers will forecast what this means for Florida practitioners in environmental, land use, and real property law. Will this open the floodgates to more regulatory takings claims by property owners? What should attorneys consider in advising their developer clients in light of this decision? And what steps can governments consider to prevent or defend against regulatory takings claims now?
The Environmental and Land Use Law Section and the Real Property, Probate, and Trust Law Section of The Florida Bar invite you to join our panel of experts (Bill Bilenky, former General Counsel for the Southwest Florida Water Management District and now of MansonBolves; Kent Safriet, of Hopping Green & Sams, who participated in writing an amicus brief in support of Koontz; and session moderator and UF Professor of Law Mark Fenster, co-author of an amicus brief in support of the Water Management District) as they discuss these issues on Wednesday, July 31 from 12:00-1:30 PM EDT. Our speakers will discuss the evolution of regulatory takings law culminating with the Koontz decision, its impact on private land owners and public agencies, and what the future holds.
